DUI Punishments


 Misdemeanor DUI

  •     City Charge: 0-6 Months in Jail.
  •     County Charge: Title 47 O.S. section 11-902 (C)(1): "Any person who is convicted of a violation of the provisions of this section shall be deemed guilty of a misdemeanor for the first offense and shall participate in an assessment and evaluation by an assessment agency or assessment personnel certified by the Department of Mental Health and Substance Abuse Services pursuant to Section 3-460 of Title 43A of the Oklahoma Statutes and shall follow all recommendations made in the assessment and evaluation and be punished by imprisonment in jail for not less than ten (10) days nor more than one (1) year. Any person convicted of a violation for a first offense shall be fined not more than One Thousand Dollars ($1,000.00).

FELONY DUIs: Title 47 O.S. Section 11-902(C)(2)

First Felony DUI 

One to Five Years (1-5) in Prison and up to $2500.00 fine.

Second Felony DUI

One to Ten Years (1-10) in Prison and up to $5000.00 fine.

Third Felony DUI

One to Twenty (1-20) Years in Prison and up to $5000.00 fine.
 

In addition to the punishments listed above, all individuals are required to get an alcohol assessment and follow the recommendations therein.

DWI: is a misdemeanor and carries up to 6 months in jail and up to a $1000.00 fine. 

Negligent Homicide: 0-1 year in jail and/or a fine from $100.00- $1000.00

Manslaughter: Four years to life in prison and up to a $10,000.00 fine.
